This privacy statement explains how we handle your personal data in the context of the (digital) night register.
Who is responsible for processing your personal data?
This privacy statement concerns the processing of personal data by the municipality that provides the nightregisteronline application to the accommodation provider.
For what purposes do we process your personal data?
We process your personal data for the following purposes:
- For activities related to creating, managing, and using an account for accommodation providers, and for securing the (digital) night register.
- To enable the municipality to verify who is staying in a building in the context of Article 438 of the Dutch Penal Code.
Which personal data do we process?
For accommodation providers and their contact persons, we process the following personal data:
- Name
- Email address (business)
- Telephone number (business)
- Password, stored in encrypted form in the night register
- Logged data relating to the use of the application: login timestamps, logs of data entries in the night register
- Optional: additional information may be processed if the accommodation provider submits a question to the municipality regarding the use of the application
For individuals who are provided overnight accommodation by accommodation providers, we process the following personal data:
- Name
- Place of residence
- Date of arrival
- Date of departure
- Type/nature of the travel document or identity document presented to the accommodation provider
- Country
Recipients of your personal data
We do not share your personal data with other parties, unless this is required by law or necessary for fulfilling legal duties.
From which parties may we receive personal data?
We receive personal data from external parties:
- For contact persons of accommodation providers and individuals who are provided overnight accommodation, we receive the aforementioned personal data from the accommodation provider.
On what legal basis do we process your personal data?
When processing your personal data, we rely on the following legal basis:
- The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Protection of your personal data
We have implemented appropriate technical and organizational measures to protect your personal data against loss, unlawful processing, and unauthorized access.
How long do we retain your personal data?
We do not retain your personal data longer than necessary for the purposes for which we process it.
Your rights
You have the right to request access to your personal data, and/or to request correction, supplementation, or deletion of your personal data, as well as the right to object to the processing of your personal data. You also have the right to request the restriction of processing and the right to data portability.
In addition to the above rights, you always have the right to lodge a complaint regarding the processing of your personal data with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
