Terms of Use
This user agreement concerns the web application www.nachtregisteronline.nl, hereinafter referred to as ‘this web application’.
Please read this user agreement carefully before using this web application. By using this web application, you accept this user agreement. If you do not agree, please leave this web application and disregard the information provided on it.
This web application is owned and operated by EquiVario Information Management Solutions B.V. (EquiVario), a company based in the Netherlands with Chamber of Commerce number 72049529.
This web application is intended solely for use by licensed municipalities and accommodation providers in the Netherlands. EquiVario makes no representation that the material on this web application is suitable for use outside the Netherlands. You are responsible for complying with the laws applicable in your jurisdiction.
- Acceptance. By using this web application, you agree to be bound by the terms of use set out in this agreement and the privacy policy for this web application, and you agree to comply with them. EquiVario and licensed municipalities reserve the right to amend these terms periodically, as they deem appropriate.
- Scope. The terms of use contained in this agreement apply solely to your use of this web application.
- Content. This web application contains information about overnight stays recorded by you for your guests. This includes, in particular, personal data, the duration of stays, and the relevant location details of the accommodation.
- Access to the web application. Each use of the web application requires an account. Logging in to the web application requires Multi-Factor Authentication (MFA): users can log in using a username and password combined with a mandatory additional authentication factor. Accounts are personal and may not be shared or transferred to others. Licensed municipalities receive an administrator account from EquiVario. With this, the municipality provides support for use of the web application within its own domain.
- Use. As an accommodation provider, you may use the web application and its associated functionalities at your discretion within the limits set by EquiVario and the licensed municipalities. Use must be solely aimed at registering as an accommodation provider, registering the accommodation locations managed by the provider, and correctly registering temporary residents at the correct address with the correct information (location). The municipality uses the web application for verifying:
- the declaration of tourist tax/water tourist tax,
- permit requirements,
- the accuracy of the information held by the municipality,
- municipal policy and in case of emergencies.
- You may not use any part of the material on this web application for commercial purposes. If you create a link to this web application, you must ensure that you do so in a fair and lawful manner, complying with all applicable laws and guidelines, and without damaging the reputation of EquiVario or licensed municipalities or using that reputation for your own benefit. This web application may not be displayed within a frame on any other website or application. You may only place a link to the homepage of this web application. All links to this web application must be removed immediately if requested by EquiVario.
- Access to services. Access to this web application as an accommodation provider is permitted by invitation from a licensed municipality. Accommodation providers must be registered to use the web application. Accommodation providers and their staff must handle the login credentials provided to them with care. Accommodation providers may authorize their personnel, under their responsibility, to use the night register. Accounts are personal and may not be shared or transferred to others. Accommodation providers must act in accordance with the applicable laws and regulations.
- EquiVario is not liable if this web application is unavailable at any time or for any period, for any reason.
- Declarations. As an accommodation provider and user of this web application, you are held responsible for the accuracy of the information you provide to the licensed municipality.
- Privacy. For more information on how EquiVario and licensed municipalities handle personal data, please refer to the privacy policy for the web application.
- Intellectual property. EquiVario owns the copyright to the functionality offered on this web application, or has obtained permission to use it, unless explicitly stated otherwise. Reproduction of the full or partial content of the web application in any form is prohibited.
- Disclaimer of warranties. The functionality offered on this web application is provided without any representation, condition, or warranty regarding its accuracy. To the extent permitted by law, EquiVario expressly excludes all conditions, warranties, and other terms that might otherwise be implied by law, common law, or equity, including—but not limited to—warranties of satisfactory quality, fitness for a particular purpose, reasonable care and skill, and non-infringement of proprietary rights. Use of this web application is at the user’s own risk, whether an accommodation provider or a licensed municipality. EquiVario accepts no liability for computer viruses, malicious software, harmful data, or other technologically harmful materials that may infect the user’s hardware or software after using this web application.
- Liability. EquiVario hereby excludes all liability for claims, losses, demands, or damages of any kind (whether foreseeable, known, or otherwise, and whether related to negligence, breach of contract, or other causes) arising out of or in connection with the use of this web application, or the information, content, or materials on it. EquiVario strives to ensure that the functionality offered on this web application is accurate at the time of publication. Nevertheless, EquiVario accepts no liability for errors, omissions, or malfunctions on the web application. Nothing in these terms of use shall exclude or limit EquiVario’s liability for fraudulent misrepresentation or any other liability that cannot legally be excluded or limited.
- Jurisdiction. The use of this web application and its content are subject to Dutch law. These terms of use, their content and form, and all non-contractual disputes or claims, are governed by Dutch law.
- Consequences. EquiVario reserves the right to suspend or terminate your use of this web application at any time and for any reason without notice. If your breach harms others, you agree to indemnify EquiVario for any resulting losses, damages, or costs. If a dispute arises regarding this agreement or your use of this web application, it will be resolved in good faith between the parties through negotiation. If these efforts fail, all controversies, claims, or disputes will be submitted exclusively to the competent Dutch court.
Changes to these terms. EquiVario and licensed municipalities may update these terms from time to time. EquiVario and licensed municipalities reserve the right to modify, add, or remove parts of these terms at their discretion. If we decide to change these terms, we will publish the updated user agreement on this web application. In some cases, changes may be communicated by email. Last updated on 24 April 2024.
